Upon graduation from Harvard Law School in 1971, Ben clerked for the Honorable James B. McMillan, United States District Court for the Western District of North Carolina, after which he joined the law firm of Smith, Moore, Smith, Schell & Hunter in Greensboro, NC in 1972. His practice included commercial litigation, bankruptcy and banking law. As a practicing litigator, Ben participated in numerous mediations in state and federal court cases as advocate for his clients.

Ben retired from his law firm (now called Smith Moore Leatherwood LLP) in 2002 after 30 years of practice with the firm and now limits his practice exclusively to serving as a neutral. He is approved to mediate cases in North Carolina Superior Court, including the North Carolina Business Court, as well as the three federal district courts of North Carolina.

Ben is rated an AV preeminent lawyer by Martindale-Hubbell.
